Reporting at the working session, Minister of Justice Ha Hung Cuong emphasized that pilot project on bailiffs was effectively implemented, reaching many positive results. Up to now, 53 bailiff offices were established in 13 localities nation-wide, in which Ho Chi Minh City has 11 offices. There are 643 people working in the 53 offices nationwide, of which 134 are enforcement agents; 295 professional secretaries and 214 staff. By 31 July 2015, bailiff offices had sent out more than 819,000 notices of enforcement and verified 781 cases for enforcement of court decisions while directly executing 322 cases involving more than VND119 billion. Bailiff offices had gradually secured a foothold in society as well as in legal aid activities, he added.

Minister Ha Hung Cuong affirmed that the pilot project on bailiffs was seriously implemented from the Central level to local ones, reaching important achievements despite short period of performance. The pilot study was successful not only in Ho Chi Minh City but also in Hanoi and others. Therefore, it is necessary and rational to continue implementing such institution in the time to come.

In order to create a legal basis for the effective implementation of bailiff institution, the Government should propose to the National Assembly to develop and promulgate the Law on Bailiff with the orientation and contents, as follows: Concretizing the spirit and content of the 2013 Constitution and ensuring synchronization with relevant laws and codes; clearly defining the legal status of bailiffs and bailiff profession; completing the model, organization and operation of bailiffs; and, orienting roadmap to develop bailiff activity along with the orientation and socialization of civil judgment enforcement system.

Discussing the report, most delegates of the Standing Committee affirmed that the bailiff activity fallen within socialized judicial activities pointed in the Resolution No. 49 of the Politburo on judicial reform strategy to 2020. Participants generally agreed with the report delivered at the working session and highly valued results of the implementation of pilot project on bailiffs in the past few years.

The majority opinions of the Standing Committee of the National Assembly endorsed the proposal of the Government to the National Assembly to enact a resolution noting the results achieved and ending pilot project on bailiffs, and to prepare to develop the Law on Bailiff in the coming time./.
