The Ministry of Justice held a press conference to inform about activities of the Justice sector in the second quarter of 2016

On 7 July 2016, the Ministry of Justice held a press conference to inform about activities of the Justice sector in the second quarter of 2016 with the participation of representatives of press agencies and Departments of the MOJ. Mr. Tran Tien Dung, Deputy Minister of Justice cum Chief Executive of the MOJ’s Office, Spokesman of the MOJ chaired the press conference.
In the second quarter of 2016, the Ministry of Justice implemented comprehensively key activities in all aspects, closely following the direction of by the Government and the Prime Minister.
Activities of the Justice sector in the second quarter and the first six months of 2016 have reached positive results
At the press conference, Deputy Minister Tran Tien Dung informed that in the second quarter and the first six months of 2016, the Ministry of Justice has paid much more attention to legal normative document development. By 30 June 2016, 73 out of 169 legal normative documents (including 41 decrees and decisions, 28 circulars, and 4 joint circular) guiding laws which have already taken effect on 1 July 2016 were issued, reaching the rate of 43,19 percent. In addition, the Ministry of Justice has appraised 151 draft legal documents and 61 international treaties. The Ministry has also made comments on 447 draft legal documents including 163 international treaties and international agreements. Noticeably, the Ministry of Justice has appraised 50 out of 50 draft decrees on business investment conditions according to the Law on Enterprises and the Law on Investment
In the field of civil judgment enforcement, in the first 8 months of 2016 (from 1 October 2015 to 31 May 2016), this activity also achieved some positive results. Accordingly, civil judgment enforcement agencies completely executed 296,041 cases, with the rate of 56.22 per cent (an increase of 9.62 per cent compared with the same period of last year).
Clearly defining responsibilities of agencies in administrative judgment enforcement
Regarding Government Decree No. 71/2016/ND-CP dated 1 July 2016 on time limits, sequences and procedures of administrative judgment enforcement, and dealing with acts of non-execution of judgments and decisions of the Court, Deputy Minister Tran Tien Dung emphasized that derived from the particularities of the administrative judgment, the Decree provides for sequences and procedures of administrative judgment enforcement under the "self-enforcement" without judgment enforcement agencies like civil judgment enforcement. In addition, to clearly define the responsibilities of the agencies in the administrative judgment enforcement, the Decree specifies duties and powers of relevant bodies in this field. In particular, the Ministry of Justice is assigned to coordinate with relevant ministries and ministerial level agencies to assist the Prime Minister in inspecting and supervising the administrative judgment enforcement; report to the Prime Minister to deal with acts of non-execution of judgments and decisions of the Court by Chairman of the provincial People's Committees, ministers, heads of ministerial-level agencies and heads of Government’s agencies. This is an important basis to determine the responsibility and strengthen management of administrative judgment enforcement in reality, helping to overcome its restrictions and backlogs of existing administrative judgment enforcement.
Improving legal normative documents on business investment conditions
At the press conference, responding to a reporter's question about the validity of Decrees on business investment conditions which have been issued, Director of Department of Civil - Economic Laws Nguyen Thanh Tu said that the Ministry of Justice has conducted its whole responsibility in appraising and making comments on draft decrees, ensuring the quality and duration of promulgation of legal normative documents on this field. He also said that, after being issued, the Ministry of Justice will continue to review such decrees and other related provisions and propose amendments, if necessary.
At the press conference, reporters asked many questions related to the fields under the state management scope of the Ministry of Justice, including state compensation, legal normative document developments, post-review of legal documents and judicial assistance. Leaders of relevant departments of the MOJ directly answered to those questions in a satisfactory manner, thereby helping reporters with more comprehensive and accurate look about the activities of the MOJ./.
