Regulation on conditions and procedures for the establishment, organization, operation and dissolution of social protection

On October 08, the Government issued Decree No. 81/2012/ND-CP on amending and supplementing a number of articles of Decree No. 68/2008/NĐ-CP dated May 30, 2008 of the Government of conditions and procedures for the establishment, organization, operation and dissolution of social protection and Decree No. 109/2002/ND-CP dated December 27, 2002 of the Government on amending and supplementing a number of articles of the Decree No. 195/CP dated December 31, 1994 of the Government on detailing and guiding the implementation of some articles of the Labor Code on working time, rest time.
Base for social protection offices to establish the competence of ministers, heads of ministerial-level agencies, the heads of the agencies under the Government, the evaluation agency is the Department of Personnel and Organization or Personnel Committee.
For the basis of social protection under the decision on the establishment of the provincial People's Committee, the evaluation agency is the Department of Home Affairs.
For social protection establishments competent to decide on the establishment of the People's Committee of districts, towns and provincial cities, the evaluation agency is the Division of Home Affairs.
Within 15 working days from the date of receipt of the written request of the competent authorities, competent people decide on the establishment of social protection in accordance with established decision.
According to this Decree, businesses, and other business establishments as business conditions, the basis of prescribed if held more than 200 hours to 300 hours per year shall be notified by writing within 7 days before performing the state management agency of local labor, where business establishments conducting business.
This Decree will take effect from the date of December 01, 2012.
