New regulations on maintenance of construction works

On 6 December 2010, the Government promulgated Decree No.114/2010/ND-CP on maintenance of construction works. Accordingly, where the construction works are put into operation the owners or their authorized representatives, the administrators, or the users shall be responsible for the maintenance works.
The provincial People's Committee will co-ordinate with the line Ministries to check randomly or regularly on 5-year basis the compliance with the regulations on maintenance in respect of construction works of grade II or higher.
If the downgrade on the quality of the construction works is found, then the owners or their authorized representatives shall have to check and take safety measures such as restriction on use or suspension of operation or repair the construction work.
The Decree shall take effect from 20/01/2011.
