National summary Conference of 5 years enforcing Law on Judicial Record

On May 5th, the Ministry of Justice organized the National summary conference of 5 years enforcing Law on Judicial Records which was chaired by Deputy Minister of Justice Nguyen Khanh Ngoc. The delegates who attended the Conference reviewed the results after 5 years enforcing the Law and made many proposes, requests with the hope that the Law will be amended, supplemented to be more effective.
Provided more than 1.240.000 Judicial Record Cards
While presentin the draft Report, the Director of National Judicial Record Central Hoang Quoc Hung identified that after 5 years deploying the Law, great resutls was achieved. Noticeably, the awereness for the importance of Judicial Record management service and the meaning of Judicial Record Card is rising everyday. The Judicial Record database building service is also being focused on since the National Judicial Record Central processes around 99.15% of received information while that of Justice Departments is around 91%.
The providing of Judicial Record cards primarily meets the personals, departments and organizations requirements and is gradually being improved in a more simple and convenient way. One million and twenty four thounsand Judicial Record cards was provided nationwide in over the past 5 years. Specially, a lot of technology methods were researched and applied to reduce the time for verifying information and returning results which also help simplifying administrative proceedings in Judicial Record.
Beside the positive results, lots of disadvantages has appeared in the process of deploying the Law. As a result, the Ministry of Justice want to amend the Law to meet the institutionalization requirements of the 2013 Constitution regulations, to be synchronized with current legal system and also to guide the Judicial Record to become more modern.
The regulations for Judicial Record Card No.2 need to be amended
The delegates from Ministries, departments not only agreed with the results and inadequacies in 5 years enforcing the Law on Judicial Record that the Ministry had mentioned but also gave a lot of recommendations on the status of the Judicial Record service, especially on the matters releating to the database management model of Judicial Record and the providing of Judicial Record Card No.2.
On the matter of Judicial Record Card No.2, there were a lot of opinion suggested that the Law need be amended in the content relating to erased criminal records in the Card eventhough there might be confliction between information access rights and personal information protection rights.
Deputy Minister of Justice praised the achieved results over the past 5 years and also listed some disadvantages that need to be dealt with. He also emphasized that the Law on Judicial Record need to change to become more practical and coincide with the condition of Vietnam in the time of international intergation.
The Minister of Justice also awarded many groups and individuals with outstanding performances in the Judicial Record service. On behalf of the Minister, Deputy Minister Le Khanh Ngoc granted Merit Certificates to some groups and individuals who represented 40 groups and 50 individuals.
