On October 18, Minister of labor, war invalids and social affairs issued Circular No.23/2012/TT-BLDTBXH on amending and supplementing some contents of Circular No.19/2008/TT-BLDTBXH dated September 23, 2008 on amending and supplementing Circular No. 03/2007/TT-BLĐTBXH dated January 30, 2007 on guiding the implementation of some articles of Decree No. 152/2006/ND-CP dated December 22, 2006 of Government on guiding a number of articles of the Law on social Insurance regarding compulsory social insurance.
Herewith, the employee or a child under the age of seven workers' healthcare abroad is entitled to sickness records, including social insurance books; Certificate examination and treatment by the medical establishment external level and employees retired list sickness mode by the employer in the form provided by the Vietnam Social Insurance regulations.
Where workers previously have paid social insurance then interrupted and then go back to work but ill within one month of return to work and social insurance, salary, wages basis for calculating the sickness regime is the salary or wages as a basis for social insurance of the month.
The employer has the responsibility to apply for social insurance organization at least 30 days prior to the employee pension. Where the employer filed later than specified, there must be a written explanation stating the reason.

This Circular will take effect from the date of December 01, 2012.
